Oral contacts can certainly be legal and binding...but someone has to have proof of the oral contract.

Now...you are writing something up and going to ask him to sign it...good luck.

He clearly doesn't have the money to pay you back and I would bet he balks at signing anything.

 

Emails that call it a "loan" or whatever....means you have to go to court to prove it....and at @$1500 will cost you that in court costs and filing fees.

that's not true. It costs $100.oo in Canada to file a claim. I'm sure he will sign it. He hasn't been difficult, or avoidant of me. He is lazy in repaying, but at least I will have something in writing before I go away.

so far his story checks out (pardon the pun). he said he will pay me Friday, when he gets paid from the farm where I referred him for work. I just checked with his employer and she said he gets paid Friday. fingers crossed
