Mgee
I live in TX. So here's my problem. Ive been dating this girl for about a year and our one year anniversary was today. She's currently 17 and turns 18 in 8 days. I just turned 22. Up until today we never engaged in any sexual conduct. I always feared that underage thing. Anyhow, we decided to celebrate our 1 year and had oral sex. Her father caught us. Now my question is this. Its only a crime if they are under 17 in texas right? I'm not really sure how to read the TX penal code on this one. sec. 22.011 if i'm not mistaken. If you could please translate this for me i would really appreciate it. Link to comment

Mgee
So here's the question remains. Do they just have to be 17, or do they have to be 17 AND my spouse in order for it not to be sexual assualt? Link to comment
brtlangst
I would think that they don't have to be your spouse if they're 17 or above, it would be rediculous to not be able to have sex with your spouse... Link to comment
avman
Texas age of consent is 17. She does not also have to be your spouse. They just put those spousal clauses in there to make sure that married couples aren't breaking the law by having sex - regardless of their ages. According to my read on that law you should be ok. Of course, that doesn't mean her father is going to like you. Link to comment
