Rose21 Posted April 16, 2010 Share Posted April 16, 2010 I lost my job a few weeks ago because the company went under at "Petland" in that specific location I was at. Everyone lost theirs. The owner of the store lost out on A LOT of money, but he is by no means bankrupt. He still owns multiple other buisnesses. He said he had the integrity to give us our paychecks and he'd mail it to us... WELL, if that location was still there I would of gotten paid LAST Friday. It has been a week, well over the amount of time that it should take to mail, espec since he's in the state. I just really want that money, NEED The money, because until I get a new job, I'm broke. I mean seriously, I have $20 for gas next week and thats IT. I really don't want to court etc, but I am going to call and if nothing comes of it what do I do?? That money is MINE! I will not work a day WITHOUT pay. Link to comment

But probably just an inconvenience due to the store's circumstances rather than a deliberate attempt to short the employees on money. Do you have his contact info? I would just call and confirm that he's mailing the cheques. I don't think he's trying to get away with anything--because I don't see how he could... Link to comment

I know you need the $$ but I would wait a few more days. I'm sure in addition to things being generally hectic- there are some complications to getting these checks out now that the business has been absolved. Wait a few more days and then try contacting your boss. If you don't have your pay within the next 2 weeks, you might want to get together with some of your old co-workers & discuss what steps to take. Surely, if you end up going to mediation or court there will be strength in numbers. Link to comment
Case_1983 Posted April 16, 2010 Share Posted April 16, 2010 Same thing happened to me. The company was sued and lost a lot of money and everyone lost their jobs but the company didnt go bankrupt. I was owed one months pay. This was May 2009.. i'm still waiting! I agree with Mar tini78 Link to comment

AuthenticAuthor Posted April 17, 2010 Share Posted April 17, 2010 This may sound a little crazy, but would it be possible for you to instead be paid in something else other than dollars? If the company's bankrupt, it can still give away precious other capital like machines, etc. From there you can sell them yourself. In the end the company writes off its obligation to you, and you get your money. Just indirectly. It may be better than waiting months to get your check. Link to comment

He still owns multiple buisnesses., Ever though he isn't broke, the he and the business are two separate things and he won't be obligated to pay you directly from his pocket. If its not in the mail box tomorrow, I'm calling him. I have his number now. And if he says he doesn't know when it will come, it's the dept of labour. Link to comment

It was just kind of an open agreement that nobody got fired, and just left at the end of our shift because we knew they were closing down. There was no paper work filed. but if that's the case, that would be AWESOME! Seriously doubt it though. Even if you quit, over here they are supposed to give you a check within a certain amount of days. I suggest you check the laws. Link to comment

(a) An employer shall pay wages to each employee who is exempt from the overtime pay provisions of the Fair Labor Standards Act of 1938 (29 U.S.C. Section 201 et seq.) at least once a month. (b) An employer shall pay wages to an employee other than an employee covered by Subsection (a) at least twice a month. © If wages are paid twice a month, each pay period must consist as nearly as possible of an equal number of days." "Sec. 61.014. PAYMENT AFTER TERMINATION OF EMPLOYMENT. (a) An employer shall pay in full an employee who is discharged from employment not later than the sixth day after the date the employee is discharged. (b) An employer shall pay in full an employee who leaves employment other than by discharge not later than the next regularly scheduled payday." "Sec. 61.051. FILING WAGE CLAIM.
