John Bendix Posted January 12, 2009 Share Posted January 12, 2009 It seems, bc it was a clerical error, the legal aspects of the divorce will be retroactive to the date of the orginal decree. The court will probably see that this was the "intent" of the original proceedings. My X fought the initial seperation agreement that was signed by both of us bc it contained a clerical error and she tried to use that to receive spousal support forever. Her attorney dropped her when she refused to acknowledge the intent of the agreement. The judge dimished her objection in chambers in like 5 minutes. Her NEW (she had 3 different ones) attorney laughed in chambers when he realized (not the last time he was misled by her) what see was trying to do.
