Here's the situation. 5 months ago I wanted to leave my apartment with the guy because I couldn't take the abuse and the messiness of my room mate anymore. At the beginning of June I was all set to leave; we even had a guy come in to take my place on the lease. I had two months left. He asked me for the $600 and like a god damn chump, I handed it to him despite the fact that I was going to be leaving in 2 weeks anyway. I AM SO ANGRY AT MYSELF. My problem is I don't know whether I should take the guy to small claims court or not. Did I have to pay him even if I was leaving right away? Should I just let it go? We're talking $850 Canadian here. I mean, Edmonton has some pretty strict laws about this sort of thing. Any other Edmontonians/Canadians have pointers here?

annie24 Posted December 13, 2007 Posted December 13, 2007 i don't live in canada, and i'm not a lawyer, but i don't think you have a case here - he asked for money, you handed it over, it sounds like that is that. what would you sue for it for? you want your money back? i know if you are leaving right away, most people would generally want at least 2 months rent so they can use that time to find someone to take your place. afterall, you did sign a year long lease, right? sorry.
