claiming back indecent images

Last year I discovered an ex boyfriend of mine had been forwarding my nudes and private messages to colleagues (including a female) and they were mocking me. Before that I broke my iphone 5 forgot the contents as the phone had been unused and broken for so long and agreed whilst we were in a relationship he could take the phone and fix it up.

 

A few days ago he contacted me after taking pictures of the extremely intimate and humilating nudes on said iphone 5, and informed me that the phone was kept in his place of work.

 

As you can imagine after the events last year im certain that this phone along with all its images and messages is shown throughout the workplace, and the fact that it is left there for people to browse whenever they fancy a laugh is devastating.

 

Ive asked for the phone to be returned and he refuses. He has told me I can have it if I pay back a loan he gave me forever ago which I just can not afford right now. Ive agreed to give him the money hes requested when I have it, bit do not want the phone and my images and private thoughts stayijg in that workplace any longer. Its very unpleasant.

 

my question is, do I have any legal standing here, after allowing him to take it originally? Could I contac the authorities to resolve this? As the last thing I want to do is contact them and make a bigger fool of myself.

A lawyer who would provide a free consultation or even a legal advice forum might serve you better than here.

 

I don't know what state/country you live in, but there may be laws set up to protect you from having such images distributed without your consent.

 

As far as physical possession of the phone goes, since you gave it to him to fix rather than keep, I don't think he's allowed to essentially steal it and use it as collateral, but you may open up Pandora's Box by pressing the issue if you really do owe him a significant loan.

Only if you are under 18 it is disseminating child pornography. Otherwise speak with local law enforcement about non-consensual sharing of intimate images and distribution of such at the workplace. As far as the phone he can not extort or blackmail you and that should also be discussed with law enforcement. Since you acknowledge the loan, set up a payment schedule in writing, notarized and document payments. Otherwise tell him to take you to court and then countersue with all these grievances.

 

As common as this is in relationships, it's best to realize once an imagine is in cyberspace it can go anywhere in nanoseconds. Find better forms of erotic sharing.

Do you really need to lecture someone who is being sexually blackmailed? It is very common and a honestly fun way to connect sexually if you or your partner are visual people. "just don't take naked pictures of yourself" is making her responsible on some level for the reprehensible and abusive actions of her ex. He STOLE these photos off of her phone.

Thankyou. The phone itself isnt an issue, he can keep it as long as the private contents is removed. The loan itself was 200, approx 18 months ago. Its been a rough month financially so that is just out of reach until payday. Im 99% sure once I pay back the money it still wont resolve as its more about spite, financially he is well off. This has given me more confidence that I do have rights in this situation, thank you.

There are a few websites that allow people to anonymously post about their exs transgressions. People post up full names etc so that if anyone puts in a name into google the report out about their cheating and whatever else comes up.

 

It happened to a friend of mine (who earned it), and he said it was a real drag to clear. He still doesn't know who posted.

Hes done a lot worse as surprising as that sounds . Terrible person who will do anything to hurt me or for a reason to be in touch. Just a terrible terrible human.

This ia the first instance ive thought I can actually do something about this, and the thought of it is so humilating. The first time, when they were just sent it killed me. But for it all to be there to just viewed and laughed at.

its a bookies he works in, hes the manager in fact. I recieved uspurred consistent abuse from one of the females employees also so I know im a target.

ive tried to rise above it all, be the better person and just be flattered by the obsessions. But vengeance has began crossing my mind now

But im trying to turn myself to christianity. So that might set me back

I too think people should keep their pants on when there's any sort of camera in the same room. This guy is slime for blackmailing her the way he's doing and she'd do well to talk to the police or a lawyer who gives a free 30 minute consultation. It's true, once something is in cyberspace, it stays there forever.

It's better to speak with lawyers and law enforcement and get appropriate justice. Taking matters in your own hands could backfire, ruin your case or escalate things...but it definitely won't solve the problems. Being equipped with what recourse you have is much better.

Please speak to an attorney or two. They often have free consultations, also, they might be willing to take your case pro bono, aka for free. So please don't think that just because you don't have the funds, that you are powerless. Basically, depending where you live there may be criminal and civil consequences to him, as well as he can be fired from his job. Just don't go it alone, get help, don't clue him in on what's coming. He is counting on you being broke, weak and not knowing how to come after him. Let him sit in that ignorance until it's too late.

 

Again, be careful not to say anything to him until you have clear legal guidance. You don't want him to cover his tracks.

No you are being victimized and blackmailed. Legal advice and recourse is there, so you don't have to be harassed like this. Even a civil action such as a cease and desist order, restraining order, whatever. However you will have to settle the debt. Especial begin regular documented payments...that way you are in the clear. Legal actions are like chess games...cool headed advanced thinking and strategies win the game.

Definitely agree wiseman2. So my only option is authorities.

Your ex is breaking the law. In the UK posting 'revenge' porn can land you in Jail from an act passed recently, and in the US it's a felony that can result in two to five years inside. Send the police to his home/place of work with instructions to not delete any pics, and once you have the pics you can perform a reverse google image search which will show you everywhere on the internet that the pics have been posted. Do not sign any BS loan agreements to him, he's crossed a line into criminal activity.
